Handling of Personal Information in Telecommunications Business

Rakuten Mobile, Inc. (hereinafter "Rakuten Mobile" or "we") will collect, use and provide third parties with personal information to the extent necessary for fulfilling the following purposes of use in compliance with the Act on the Protection of Personal Information, the provision of Article 4 of the Telecommunications Business Act concerning the secrecy of communications and other relevant laws and regulations when conducting operations related to the provision of telecommunications services.

Use of Personal Information, etc.

1. Purposes of use

We will collect personal information, etc. about you (i.e., the customer) as described below in order to fulfill the purposes of use stated below. Personal information, etc. about you collected by us includes information that you give us directly, information about your use of our services, and information collected from third parties. As for the purpose of third-party provision, please refer to "3. Third-party provision."

"Personal information, etc." includes all information from which you are directly or indirectly identifiable as an individual. Among "personal information, etc.," "personal information" refers to "personal information" as defined in the Act on the Protection of Personal Information.

Of note, even after the termination of various contracts you have with us, we may store and use your personal information for the purpose of fulfilling legal/regulatory obligations, collecting fees, resolving conflicts, solving problems and/or exercising rights, and with the objective of conducting various surveys necessary for such purpose.

  1. *1Cases in which we use information referred to in [5] that is subject to secrecy of communications —even if it is in relation to the aforementioned operations—shall be limited to cases where: it is deemed to be a justifiable act in business or an act of self-defense or aversion of present danger, or other justifiable grounds for noncompliance with the law are deemed to exist; or your consent has been obtained on an individual basis.
  2. *2We may obtain your consent on an individual basis for using your communication history, geolocation information, app launch history, phonebook information, photos, videos and other personal information, etc., in consideration of your privacy.

2. Alteration of purposes of use

In cases where any purpose of use referred to in 1. above is to be altered, the purpose of use shall not be altered to the extent that the pre-altered purpose of use is reasonably deemed to have become irrelevant.

Of note, in cases where personal information is to be used beyond the extent necessary for fulfilling the purposes of use referred to in 1. above, we will clarify the purpose of use and obtain your prior consent each time.

3. Third-party provision

1) Provision of information to Rakuten Group

Comprised of Rakuten Group, Inc. (hereinafter "Rakuten") and its subsidiaries and affiliates, the Rakuten Group provides many different kinds of services. We may provide information to the Rakuten Group as follows, to enable you to use such Rakuten Group services in a convenient and comfortable manner. Of note, we will not provide information to third parties beyond the scope prescribed in Handling of Personal Information in Telecommunications Business to which you have consented, in accordance with the Guideline on Protection of Personal Information in Telecommunications Business.

For the purpose of preventing fraudulent contracts, non-payment of fees, etc.

5. Handling of information subject to secrecy of communications

We will collect, use or provide third parties with information subject to secrecy of communications such as communication history, call history and caller information in accordance with the provision of Article 4 of the Telecommunications Business Act and other relevant laws and regulations only in cases where: we have your consent; we are complying with a warrant issued by a judge; it corresponds to an act of self-defense or aversion of present danger; or there are other justifiable grounds for noncompliance with the law.

6. Handling of personal information, etc. collected through applications

We may collect personal information, etc. about you through smartphone applications provided by us. When doing so, we may obtain your consent on an individual basis for handling your communication history, geolocation information, application launch history, phonebook information, photos, videos and other personal information, etc.
Please refer to the following privacy policies established separately for each application provided by Rakuten Mobile.

7. Handling of sufficiently anonymized geolocation information, etc.

We may use or provide third parties with your geolocation information that we collect when you use our telecommunications services after sufficiently anonymizing such information in a manner that makes you unidentifiable not only at the communication level but also at the individual level.
